Fairfax County Judge Convicts 19-Year-Old Illegal Alien on 9 Assault Counts

FAIRFAX COUNTY, Virginia — The U.S. Department of Education has opened a Title IX investigation into Fairfax County Public Schools following reports that the district failed to adequately respond to multiple complaints of a male student sexually assaulting female students at Fairfax High School.

The probe centers on whether the district discriminated on the basis of sex by not properly addressing the allegations against Israel Flores Ortiz, who was enrolled as a high school junior despite being nearly 19 years old. Flores Ortiz, originally from El Salvador, entered the U.S. illegally in 2024 and was released into the country by the Biden administration. He faced more than a dozen assault charges for allegedly groping female students, many aged 13 and 14, over several months in school hallways.

On Thursday, a judge found Flores Ortiz guilty on 9 of the 13 counts of assault. He was acquitted on three counts and one was dismissed. According to parents and reports, the incidents involved him approaching girls from behind and groping them between the legs, including touching private areas—actions that went beyond the district’s initial description to parents of “touching” or “inappropriate touching.”

Fairfax County Schools stated that the district is fully cooperating with the federal investigation and has retained outside counsel, specifically the law firm McGuireWoods, to conduct its own independent review of the matter.

Stephanie Lundquist-Arora, a Fairfax County mom and leader of the Fairfax chapter of the Independent Women’s Network, criticized the district’s response, describing the case as symptomatic of broader issues across multiple levels of local government. She pointed to policies that she said created an environment prioritizing protection of the suspect over student safety.

Lundquist-Arora noted that one of the first actions by Governor Abigail Spanberger was to declare that the state would not cooperate with federal immigration authorities (ICE). At the county level, she highlighted the Commonwealth’s Attorney—described as a George Soros-backed prosecutor—who sought bail for Flores Ortiz, as well as the Board of Supervisors’ designation of Fairfax as a sanctuary jurisdiction with a “trust policy” that prevents school or local officials from inquiring about immigration status.

“Taxpayers are funding this type of behavior,” Lundquist-Arora said, adding that the district appeared to sanitize the severity of the incidents in communications to parents. She argued that the handling reflected a pattern of protecting the perpetrator at the expense of the victims’ safety, questioning how far the system would go “to sacrifice these girls’ safety on the altar of equity.”

The case echoes earlier controversies in Virginia schools, including the 2021 Loudoun County incidents where officials were accused of failing to report assaults by a student who identified as gender-fluid in order to access girls’ restrooms.

Lundquist-Arora also raised concerns about one count on which Flores Ortiz was found not guilty due to a lack of video footage in a bathroom area, contrasting it with the broader “Me Too” emphasis on believing victims of harassment, particularly young girls.

Fairfax County Public Schools has faced scrutiny in the past for its handling of student safety and assault cases. The current Title IX investigation examines whether the district’s response—or lack thereof—to repeated reports violated federal protections against sex-based discrimination.

The incidents occurred in a school district once regarded as among the top in the nation, though Lundquist-Arora noted significant changes in recent years. Flores Ortiz remains in custody, with federal immigration authorities having issued a detainer.

This development has sparked renewed debate over school safety, immigration enforcement, failed sanctuary policies, and the balance between due process and protecting minor students in public education settings. Fairfax County Schools officials have not commented in detail beyond confirming their cooperation and internal review.
