At the center of the legal fallout is Dr. Auchalie Mothupi, the former Acting Municipal Manager, who has formally opened dockets against the district’s political leadership to halt what he describes as the unchecked looting of public resources.
The unprecedented legal intervention highlights a severe breakdown in local government accountability. According to Dr. Mothupi, the current administration has entirely abandoned its oversight duties, choosing instead to protect compromised officials rather than the communities reliant on basic municipal services.
A Trail of Ignored Forensic Audits
The foundation of the criminal case rests on a pattern of willful ignorance regarding multiple high-level investigations. Dr. Mothupi asserts that the municipality’s leadership deliberately failed to act on damning findings presented by the Special Investigating Unit (SIU), the Auditor General, and independent forensic investigators.
A critical flashpoint occurred in April when a comprehensive forensic report compiled by the Modiboa attorneys was officially handed over to the district municipality. Rather than triggering immediate disciplinary hearings, Dr. Mothupi says his attempts to implement consequence management were aggressively blocked.
“When I intended to start with the process of consequence management, I got resistance and opposition from the same councilors,” Dr. Mothupi stated. He interpreted this pushback as a deliberate directive from the political leadership to allow corrupt activities to continue under their watch—a position he refused to endorse, ultimately forcing his hand to seek external legal remedies.
R10 Billion Unaccounted For and a Public Health Crisis
The financial implications of this administrative paralysis are staggering. Allegations indicate that the municipality has failed to account for more than R10 billion in public funds. This massive fiscal hemorrhage has translated directly into a catastrophic failure in service delivery.
Residents are currently bearing the brunt of the mismanagement. Dr. Mothupi points out that over 10 critical water infrastructure projects were abandoned mid-development and left unfinished. Consequently, communities are enduring prolonged water shortages and navigating streets flooded with raw sewage leaks. The resulting environmental hazards pose a direct and severe threat to the health and daily livelihoods of local residents, yet no officials have faced disciplinary action for the loss of the R10 billion or the subsequent infrastructure collapse.
Active Police Dockets and Fraud Investigations
Confirming the escalation, North West police authorities acknowledged the opening of multiple criminal dockets linked to the municipality. The registered cases include two counts of fraud and one count of intimidation stemming from internal board committee disputes.
One specific fraud case involves a 47-year-old complainant who outlined a scheme of non-performance by external contractors. The complainant alleges that the local municipality entered into binding agreements with various organizations to execute specific municipal work. Despite the municipality releasing full payments, these organizations completely failed to deliver on their contractual obligations as recently as April 2026.
Furthermore, the complainant detailed historical financial damages, noting that the municipality suffered losses exceeding R6 million between August 2018 and December 2020 due to service providers being paid without performing their duties.
Currently, no suspects have been taken into custody. The dockets are under active investigation by the local commercial crime unit, which is working to untangle the complex web of municipal contracts and missing funds.
