EASTERN CAPE — In a decisive ruling that underscores the region’s strict stance on gender-based crimes, the Mthatha Regional Court has delivered an 18-year jail sentence for raping a minor, bringing long-awaited justice to a devastating 2023 case. The conviction centers on a severe breach of trust involving a 14-year-old girl and a man who was a guest in her family’s home.
The horrific incident occurred on the night of November 11, 2023, in Mthatha’s Slovo Park. According to court proceedings, the teenager was asleep in the same bed as her sister, her father, and her father’s 34-year-old male friend, Xola Sobhalule. At approximately 03:00, while the others were sleeping, Sobhalule took advantage of the situation and raped the minor.
A case was immediately opened with local authorities, but it was the swift action of the local community that ultimately led to the suspect’s apprehension. On November 14, 2023, outraged Slovo Park residents confronted Sobhalule after learning of the assault, resulting in a physical altercation. The perpetrator was hospitalized under strict police guard before being formally taken into custody. Despite the severity of the allegations and the community’s outrage, Sobhalule was granted R2,000 bail during his initial court proceedings while awaiting trial.
The legal process finally concluded on Tuesday, August 4, 2026, when the Mthatha Regional Court found Sobhalule guilty on a charge of rape and imposed an effective 18-year jail term.
Following the verdict, OR Tambo District Commissioner Major General Norman Modishana released a statement praising the meticulous police work that led to the successful prosecution. Major General Modishana specifically commended Sergeant Mdikane, an Investigating Officer attached to the Mthatha Family Violence, Child Protection and Sexual Offences Unit.
According to the Commissioner, Sergeant Mdikane’s professional handling of the complex investigation ensured that the legal system ultimately served justice for the girl child. Law enforcement officials have reiterated that this substantial 18-year jail sentence for raping a minor sends a stern warning to predators that the exploitation of vulnerable children will be met with the full, unforgiving might of the law.
