FREE STATE — The Themba Malinga rape conviction has culminated in a life prison term for the 30-year-old Boiketlo Village man, alongside an additional 15-year sentence for attempted murder. Delivered at the Phuthaditjhaba Magistrate’s Court on Thursday, 6 August 2026, the landmark ruling brings an end to a harrowing multi-year legal battle and a prolonged pursuit of justice for a 25-year-old survivor.
The horrific ordeal began on the night of 16 August 2022. At approximately 21:00, the victim was walking alone near a local tavern when she was intercepted by Malinga, an acquaintance. According to court proceedings, he forcefully covered her mouth, dragged her into a nearby donga, and demanded she undress before raping her. The violence did not end there; Malinga forced the woman to his residence, where he subjected her to repeated sexual assaults throughout the night.
The brutality escalated at roughly 04:00 the following morning. In a vicious attempt to silence his victim, Malinga attacked her with a broken beer bottle, inflicting severe lacerations to her neck. Believing he had killed her, he fled the scene and left her for dead without seeking medical assistance. Severely injured, the woman miraculously managed to escape to a neighboring house, where locals aided her and arranged for her transport to a hospital.
While police successfully traced the suspect’s whereabouts later in 2022, an arrest could not be immediately executed, allowing him to evade justice for years. The breakthrough in the case arrived unexpectedly in 2025 when the survivor crossed paths with Malinga in public. Acting swiftly, she immediately reported his location to the nearest police station, leading to his prompt arrest. He was subsequently denied bail and remained in police custody as the trial unfolded.
The successful prosecution was a collaborative effort between the Phuthaditjhaba Family, Child Protection and Sexual Offences (FCS) Unit and the National Prosecuting Authority (NPA). The matter was meticulously investigated by Detective Warrant Officer Malefu Doreen Mbule. During the trial, Ms Nteo represented the State, presenting a formidable case before Magistrate Msimanga, who ultimately found Malinga guilty on all charges.
The outcome has been widely praised by provincial law enforcement leadership. Free State Provincial Commissioner, Lieutenant General Thabang Lesia, publicly welcomed the severe sentence. He specifically commended Detective Warrant Officer Mbule for her relentless dedication and diligent investigative work, which ensured that a dangerous predator was finally removed from the streets and brought to justice.
