EASTERN CAPE — Delivering a major blow to gender-based violence in the province, the Mthatha Regional Court has handed down a strict 15-year prison sentence to a 24-year-old local man. The ruling, finalized on Wednesday, August 5, 2026, brings long-awaited justice to a severe 2019 sexual assault case involving the victim’s former partner, signaling a strong stance on forensic accountability in the region.
The convicted man, Thandokuhle Nondoda Mafinana of the Bongweni locality, was found guilty of the assault and rape of his then 19-year-old ex-girlfriend. The incident, which took place on April 2, 2019, at approximately 16:20, was set into motion under false pretenses.
According to court records, Mafinana contacted the victim under the guise of a reconciliation meeting to discuss and resolve ongoing relationship disputes. The meeting ultimately relocated to his brother’s residence in the same Bongweni locality. Once inside, the situation turned volatile; Mafinana barred the young woman from leaving the premises and demanded sexual favors. When she refused, he violently assaulted and raped her.
Provincial police spokesperson Brigadier Tembinkosi Kinana confirmed the swift initial response by local law enforcement following the ordeal. Demonstrating immense bravery, the 19-year-old victim reported the crime directly to the Ngangelizwe Police Station, opening formal dockets for both assault and rape. Acting on her statement, authorities tracked down and arrested Mafinana on April 6, 2019, just four days after the attack.
The road to conviction required meticulous forensic patience. Following his initial arrest, Mafinana was released on a warning to allow investigators time to process crucial DNA results.
Prosecuting authority spokesperson Luxolo Tyali highlighted that the successful 15-year sentencing was the direct result of tireless evidence gathering. Once all outstanding forensic evidence and DNA profiles were successfully secured and added to the state docket, prosecutors were able to build an unassailable case that ultimately led to the Mthatha Regional Court’s guilty verdict and subsequent sentencing this week.
Beyond the decade-and-a-half incarceration term, the court enacted a vital protective measure for the community: Mafinana has been officially declared unfit to possess a firearm, ensuring he remains stripped of his right to own weapons upon his eventual release.
