CAPE TOWN, WESTERN CAPE — The National Assembly will debate a newly drafted Section 89 impeachment framework today, acting on a Constitutional Court order to overhaul its presidential removal mechanisms. Lawmakers are reviewing the fifth report of the Rules Committee, designed to cure the constitutional defects identified in the legislature’s previous processes.
The legislative chamber is scheduled to open at 10:00 a.m., though the highly anticipated review of the committee’s findings is positioned as the fifth item on the daily order paper. Members must first conclude four preceding orders and debates before shifting their focus to the new guidelines. These procedural updates are inextricably linked to the ongoing Phala Phala controversy and the active impeachment proceedings against President Cyril Ramaphosa.
The push for legislative reform was triggered by a May judgment from the Constitutional Court, which declared specific elements of Parliament’s Section 89 inquiry procedures invalid and unconstitutional. To comply with the judiciary’s directive, a specialized sub-committee was tasked with the intricate technical work of redrafting the rules. The drafting phase was highly collaborative, integrating detailed proposals from various political parties and extensive guidance from Parliament’s internal legal advisors.
The resulting document was formally approved on the 19th by the Rules Committee, which operates under the leadership of National Assembly Speaker Thoko Didiza. Having successfully navigated the sub-committee and final committee stages, the revised guidelines are now officially tabled before the National Assembly. Political parties will now scrutinize the document as the legislature moves to finalize its constitutionally compliant impeachment protocols.
